Complaint and Reporting Guidelines

Lingchuanfeng (Guizhou) Information Technology Co., Ltd. and its affiliates (hereinafter referred to as "BaiShan Cloud" or "we") are cloud service providers specializing in edge cloud solutions. To standardize complaint handling procedures and protect rights holders' legitimate interests, BaiShan Cloud has formulated these guidelines in accordance with relevant laws, regulations, industry practices, and corporate policies. 

We aim to clearly outline our requirements for receiving and processing complaints through this policy. Please carefully read and understand these terms. For any inquiries, feedback, or suggestions, please contact us via the provided ways. 

  1. Reporting Guidelines

1.1Platform Statement 

The cybersecurity services and products provided by BaiShan Cloud constitute fundamental technical services in the network sector. 

These guidelines are designed to efficiently address illegal activities and protect rights holders' legitimate interests. Please note that BaiShan Cloud does not assume responsibility for all suspected infringement or illegal activities by users. Any reported issues will still be promptly forwarded to the relevant parties in accordance with legal procedures, unless otherwise specified by law. 

1.2 Applicable Scenarios 

These guidelines specifically address reports of infringement or illegal activities involving BaiShan Cloud services (see Section 2: Types of Reports). Users experiencing disputes related to BaiShan Cloud services are advised to contact BaiShan Cloud Customer Service [Contact: 0851-88547201] for feedback. Such cases are not covered by these guidelines. 

1.3 Warranty Obligations 

As a informer, you shall be responsible for the authenticity, accuracy, and completeness of the submitted information. Should any direct or indirect losses be incurred to the reported party, Baishan Cloud, or other third parties due to false information (whether intentional or negligent), you shall bear corresponding legal liability. 

1.4 Careful Reading

1.5 Updates 

Baishan Cloud reserves the right to revise and improve these regulations from time to time. Please refer to the latest version published by Baishan Cloud. 

2.Types of Complaints 

Based on the platform's service nature and common violations/infringements, we accept reports categorized into the following types. You must strictly comply with the specific requirements for each type when submitting reports and supporting documentation. If you fail to provide complaint information and supporting documents in strict compliance with the platform's requirements, your report may be deemed invalid. Specific complaint categories are as follows: 2.1 Illegal Information Reporting: 

Refers to violations of laws such as the Cybersecurity Law of the People's Republic of China and the Internet Information Service Management Measures by the reported party, including the creation, reproduction, dissemination, or distribution of prohibited content such as pornography, gambling, political-related materials, terrorism-related information, drug-related materials, and other explicitly banned content. 

2.2 Illegal Activities Reporting: 

Refers to illegal activities on the reported party's website, such as cyber attacks, online fraud, or the distribution of Trojan viruses.

2.3 Intellectual Property Infringement Complaint: 

Refers to civil rights violations by the reported party. 

If your civil rights are infringed upon, you have the legal right to request the infringer to cease infringement and bear liability. We therefore recommend notifying the infringer or the infringing website/app first to stop the infringement and protect your legitimate rights.

If you need to report issues through Baishan Cloud due to contact difficulties, we will legally forward the submitted materials to the reported party upon receiving qualified complaint information. We will promptly notify you of any feedback received from the reported party. 

3.Notification Requirements

3.1 Illegal Information Reporting: 

You must provide an accurate URL, specify the type of report, briefly describe the reported matter (optional), and submit relevant proof screenshots (if applicable). To facilitate communication and feedback, you must also provide a valid email address for contact. 

3.2 Reporting Illegal Activities 

You must provide an accurate reporting URL, specify the type of report, briefly describe the reported matter (optional), and submit relevant proof screenshots (if applicable). To facilitate communication and feedback on handling progress, you must also provide a valid email address. 3.3 Complaints Regarding Infringement 

If you believe Baishan Cloud users are suspected of infringing your intellectual property rights or other legitimate civil rights, as the rights holder, you may submit relevant materials for complaint according to the following requirements: The rights holder shall submit written notification materials containing the following contents: 

3.3.1 Rights holder's information and supporting documents, including: Name (company name), contact details, address, business license (for organizations) or ID card (for individuals), and authorization certificates proving the rights holder's legal status; 

3.3.2 Preliminary evidence of infringement, including: (1) Ownership certificates proving rights: Including but not limited to copyright certificates, trademark certificates, or other valid ownership proofs issued by authorized institutions; (2) Evidence of the reported party's infringement of your legitimate rights, including written factual statements detailing the infringing party's name, specific acts, time, and your demands. Such statements must be stamped (for legal entities) or signed (for individuals).

3.3.3 Rights Holder's Warranty The rights holder must declare the following in the notification and affix a seal (for legal entities) or sign (for natural persons): All statements and materials provided in the notification are true, valid, and lawful. The rights holder guarantees to bear all legal liabilities arising therefrom, including but not limited to any losses caused by necessary measures taken by us based on the rights holder's notification. 

3.3.4 Agency Documents (If Required) If you authorize an agent to initiate a report and handle related matters, you shall also provide: the agent's name (company name), contact information, address, business license (for entities) or ID card (for individuals), and power of attorney (stamped by legal entity/signature by natural person). 

4. Submission Channels 

There are two methods to submit relevant materials to us: (1) Fill out and upload all the aforementioned information and materials through Baishan Cloud's Reporting Center platform; (2) Send clear scans of all paper documents via email to our designated reporting mailbox: [jubao@baishan.com].

5. Notification Processing 

5.1 Regarding the illegal information and violation clues provided by the informant, Baishan Cloud will take necessary measures in accordance with legal provisions after verification. 

5.2 Regarding infringement reports, we will conduct a formal review of the notification upon receipt. If the notification fails to meet the aforementioned requirements, the whistleblower shall submit supplementary evidence or materials within the specified period, and the rights holder shall cooperate accordingly. If the rights holder fails to complete the necessary supplements within the deadline, we will consider the infringement notice invalid. 

5.3. If the notification meets the aforementioned requirements, we will legally forward the submitted materials and information to the reported user. Should the notified party provide any feedback, Baishan Cloud will promptly notify you.
